Terms and Conditions
This is agreement outlines the terms and conditions of using froggybank.co.uk. It clarifies our obligations to you and your obligations as our member. By signing-up to froggybank.co.uk you agree to the following terms and conditions.
1. General1.1 We agree that we will
- Not send you any unsolicited emails
- Not rent or sell your details to any third parties
- Not charge your credit card or bank account for any reason
- Never ask you for your credit card details
- Handle your details carefully in line with our privacy policy
1.2 You agree that you will
- Contact froggybank though our online helpdesk and not contact the merchant directly with any cashback related queries
- Only contact the merchant directly for any returns, issues regarding delivery, warranty or quality of product you bought
- Not register more than one account with froggybank
- Not allow other people to use your account or make purchases for others using your account
2. Membership2.1 Eligibility:
Individual Accounts: Only for UK residents over the age of 16. Only one account per person and 2 accounts per household is allowed.
Charity Accounts: Only for registered charities in the UK and selected international charities.
Fundraiser accounts: Only for UK residents, schools, colleges, clubs, churches and organizations who raise funds for any legitimate cause. We reserve the right to disallow fundraising accounts if we believe the cause is immoral or unsuitable for our website.
Webmaster accounts: Only for website owners who are residents of the UK. If you are from another country and have website with predominantly UK traffic, please contact us first for approval.
2.2 You can cancel your membership anytime by just submitting a support ticket in our helpdesk.
2.3 No one, except the account holder should use their account for making purchases through froggybank. To prevent misuse, we do not allow our members to make purchases on behalf of others like friends or family.
2.4 You agree to keep your login details, including user name and password safe and never disclose this to anyone.
2.5 We retain the first £5 of cashback you earn each year as admin fee. This is calculated from your date of joining. In any year, we will not deduct more than £5 from your earnings, regardless of your earnings the year before. If you do not earn enough to cover the admin fee, we will not charge you the difference. This admin fee is not deducted for registered charities who raise funds using our sites.
2.6 Any accounts by a non-UK resident (except explicitly permitted accounts like international charities) will be terminated and no cashback will be paid.
2.7 Any of the following will be construed as an act of dishonesty leading to account termination, an immediate ban from using our entire network of websites and legal action.
- Registering more than one account with froggybank
- Misusing merchant offers and repeatedly applying for services you do not intend to use
- Submitting false claims for cashback
2.8 We reserve the right to amend, impose conditions upon or cancel your membership at our absolute discretion at any time, usually when we suspect breach of our terms, spamming or other activities which we believe could damage our brand values or our service.
2.9 We will review member accounts periodically, usually every year and terminate accounts which, in our opinion are inactive.
2.10 If we terminate or suspend accounts, any accrued earnings in these accounts will be forfeit.
2.11 We do not send you unsolicited emails, but it is a condition of your membership that you have a valid email address where we can contact you about your payments or account. We will only send you newsletters with special offers etc, if you choose the option to receive them in your profile page.
3. Earning Cashback on your purchases3.1 When you join froggybank and use our links to make an online purchase, we get a commission from the merchant for referring the sale. We pay this commission to you as cashback. You can choose to get all of this paid to you by BACS or paypal, or donate to a cause of your choice.
3.2 You need to be logged into froggybank.co.uk and use our links before you visit the merchant and complete your purchase wholly online for your transaction to track.
3.3 The amounts of cashback you earn and the conditions, if any, are displayed in each merchant description. Any offer of cashback made by froggybank and not by the merchant directly.
3.4 While cashback amounts are paid as advertised in most cases, we do not provide guarantees of payments or reporting, as we have to rely on third party networks for tracking and merchants for paying commissions.
3.5 If the merchants do not pay us, for whatever reason - including cancelled orders, returns or offline orders - we will not be able to pay you.
3.6 Please note that we only advertise the merchant's offers on our website by displaying their links and products. We do not sell any of these products or services ourselves. When you shop from a particular retailer, you pay them directly and they are responsible for the product/service you buy, delivery, after sales service or warranties.
3.7 Whilst we do take a lot of care in choosing our merchant partners, we will not be responsible for any difficulties you have with the retailer or the product. No information on our website should be construed as advice, recommendation, warranty or guarantee about products or services offered by our partner merchants.
3.8 Any queries regarding cashback on transactions you made through our site must made by using our online helpdesk, within 90 days of your purchase.
3.9 Maximum cash back Promise: After you make a purchase using the links on our site and find another cashback site offering a better rate, we will match this and pay you the difference. To be eligible for this, you need to submit a support ticket within 48 hours of making a valid purchase with your transaction details and a link to the offer you want us to match. The cashback website in question should have been in service for at least 1 year. This offer should be verifiable when we check, which could be any time up to 3 working days of you submitting your query.
3.10 Customer Service Promise: All valid new support tickets submitted by our individual members to the correct department in our helpdesk will be answered within 24 working hours. If we fail to do this, we will add £1 per working day of delay into your froggybank account. This only applies to our initial response to your queries and not subsequent responses while your issue is being investigated. Our working hours are Monday to Friday 9 am to 5pm, excluding public and bank holidays.
3.11 Disputes: You must contact us through our support desk with complaints are disputes regarding cashback amounts or our service. We will take all reasonable steps to resolve the issue, but in the event of a disagreement, our decision will be final and binding.
4. Donations, Fundraising and Charities4.1 You can choose to donate a proportion of your earnings to charity or a fundraiser using your profile page.
4.2 All money which our members donate to charity will be paid to charities on regular basis, usually monthly. If for any reason we are unable to pay or decide not to work with any particular charity, the donations due to that charity will be made to other charities at our discretion.
4.3 A listing on froggybank.co.uk of any charity, fundraiser, webmaster or a cause is not an endorsement of froggybank.co.uk to them, nor an endorsement of froggybank.co.uk by them.
4.4 We reserve the right to add, amend, allow or disallow any cause, fundraising page or charity on our site.
5. Payments5.1 We send payments to members on a monthly basis, after we receive the payments from the merchants. This is either to a Paypal account or BACS transfer to a UK bank account. For charities, we may choose to pay their donations by cheque or credit card or by pay to support some of their specific projects/campaigns.
5.2 You are responsible for keeping your profile and contact details up to date to avoid delays in payments. If we send your payment and it is lost due to incorrect details in your profile, we will not resend the same payment again.
5.3 Any queries regarding payments sent to you should be made within 30 days of us sending you the payment.
5.4 Referral payments: When you refer other members using your referral link or your own page on froggybank, you will be eligible for a payment of £2.50 for each person who joins using your link or page. This £2.50 is only paid into your froggybank account when we deduct the first year's admin fee of £5 from their cashback earnings.
6. Modifications to our terms and policies6.1 We reserve the right to modify our terms, conditions and policies and this agreement at our sole discretion. We will do this so by amending the terms on our website www.FroggyBank.co.uk.
7. Disclaimers and Limitation of liability7.1 Fundraising pages/accounts are which are listed on our website are for our members use. While we do our best to monitor these causes, we do not have any control over how the fundraisers/charities spend the money and we will not be liable for their promotions, representation or actions.
7.2 While we make little delay from our end and take utmost care in reporting, we will not be responsible if there are delays in errors in their tracking or reporting. We reserve the right to adjust your cashback account in certain circumstances, including inaccuracies in reporting or non-payment by merchants.
7.3 The cashback amount you get paid for your particular transaction may vary if the merchant changes their commission rates. If there are any errors in advertising, we can only pay you up to a maximum of 100% of what we get paid by the merchant on these occasions.
7.4 Our website and service are provided on "as is" and "as available" basis without any warranty of any kind on availability, functionality, fitness for a purpose, security or accuracy of information.
7.5 Froggybank.co.uk will not be liable for any indirect, incidental or consequential loss or damage of any kind arising out of use of our website or inability to participate in our cashback program.
7.6 You agree to indemnify Froggybank.co.uk, its employees and agents harmless from and against all liabilities, damages, losses, legal fees in relation to any claims or actions brought against us arising out your breach of these terms and conditions or that of our participating retailers.
7.7 Our failure to enforce any of these terms and conditions will not waive our rights to enforce any of these terms and conditions.
7.8 These terms and conditions do not affect your statutory rights and will be governed by the laws of the United Kingdom whose courts will have exclusive jurisdiction over any disputes arising in connection with them.
